A Marlow man who is already registered as a sex offender now sits behind bars at the Stephens County Jail for illicit snapchats he sent to a minor.
According to court documentation, Cory James Kern, of Marlow, now faces a charge of lewd proposals to a child under the age of 16 after a former felony conviction. Records show on May 22, 2017, Kern was convicted of rape in the second degree, a felony, for a case in 2016 and ordered to 12 years in Department of Corrections with all 12 years suspended. Less than a month after his sentencing, the State made a motion to revoke Kern’s suspended sentence for violating conditions of probation and parole. During this time in court, Kern was sentenced to serve five of the 12 years from his original sentence.
Lewd proposals to a child under 16, a felony, is punishable by no less than thee years and no more than 20 years imprisonment. After a former felony conviction, however, the punishment ranges from 10 years to life, and if found guilty, Kern will have to serve at least 85 percent of whatever sentence is handed down.
Along with the new charge filed on Aug. 30, the State also made a motion to once again revoke Kern’s suspended sentence from conviction of rape in the second degree.
Affidavits show the lewd acts charge stems from a report filed in the Stephens County Sheriff’s Office around 7:30 a.m. Tuesday, Aug. 27. Records indicate the report came from a mother who stated her teenage child “was communicating electronically for certain with a registered sex offender.”
Deputies set up an interview with Kern at the sheriff’s office, where Kern was read his rights and signed a waiver to proceed.
During the interview, Kern first tried denying knowing the juvenile, though he later told deputies he knew who the minor was. Kern also told law enforcement the teen was the first to make contact with him via Snapchat, and when the initial contact was made he asked how old the juvenile was and learned they were 15.
Kern told deputies he advised the juvenile he could not communicate with them because he was a registered sex offender, though he also told the minor “OK” but continued conversations.
According to reports, Kern told deputies the minor advised they needed a friend because their grandmother was in the hospital and their grandfather didn’t want anything to do with them.
Kern stated he was just trying to help the juvenile through the hard times and be a friend, though the minor almost immediately “sent him nude pictures.”
When deputies asked if Kern sent any images back, he said no and then “finally admitted to sending pictures of adult genitalia” but said he got the images off the internet, reports show.
Reports show Kern knew he could get in trouble if he sent any of himself, so that’s why he selected photos from the internet. Kern also reported talking to the juvenile via text, though confirmed he only sent and received images via Snapchat.
After the confession of sending pornographic material to a juvenile under 16, deputies placed Kern under arrest and booked him into the Stephens County Jail.
Kern’s bond is set at $250,000 and he will appear in court for a preliminary hearing conference at 9 a.m. Oct. 23.
